Cap Reached for Second Allocation of Returning Worker H-2B Visas for Fiscal Year 2026

U.S. Citizenship and Immigration Services (USCIS) announced that it has received enough petitions to meet the cap for the additional 27,736 H-2B visas allocated for returning workers with start dates between April 1 and April 30, 2026, under the FY 2026 supplemental cap temporary final rule. April 21, 2026, marked the final receipt date for these petitions. These visas are intended to help U.S. businesses address seasonal or temporary labor shortages, particularly in key sectors of the economy. Earlier, on January 30, 2026, the Department of Homeland Security (DHS) and the Department of Labor (DOL) jointly introduced the FY 2026 temporary final rule, which made up to 64,716 additional H-2B visas available. However, these supplemental visas are limited to employers who can demonstrate that they would suffer irreparable harm without the requested workers, as confirmed through a required attestation submitted with their petition.
