Court Order on Hold Policies

On June 5, 2026, the U.S. District Court for the District of Rhode Island issued an order in Dorcas International Institute of Rhode Island v. USCIS vacating USCIS Policy Memoranda PM 602-0192 and PM 602-0194, as well as Policy Alert PA 2025-26. The court entered final judgment on June 11, 2026, making the decision effective immediately and applicable nationwide. As a result, USCIS must treat these policies as though they are no longer in effect while any potential appeals or further judicial review are pending. The vacated policies had been implemented in response to Presidential Proclamations 10949 and 10998, which were intended to strengthen immigration screening, vetting, and national security measures. Although USCIS has stated that it strongly disagrees with the court's ruling, the agency confirmed it will comply with the order. The lawsuit was brought by several non-governmental organizations and labor unions representing millions of immigration applicants, who challenged the legality of the policies.
