Recent Court Order on Hold Policies

On August 24, 2026, the U.S. District Court for the Northern District of California issued an order in Red Eagle Law, L.C., et al. v. Joseph B. Edlow blocking USCIS from enforcing Policy Memoranda PM-602-0192 and PM-602-0194. As a result, USCIS must resume adjudicating affected immigration benefit applications through its normal processing procedures rather than keeping them on hold. The court also certified a class covering certain citizens or natives of the 39 countries identified in Presidential Proclamations 10949 or 10998, as well as individuals from the Palestinian Authority, who have pending Form I-589 asylum applications or other USCIS benefit applications affected by the policy holds and not yet finally adjudicated. The memoranda had imposed adjudication holds as part of enhanced national-security screening and vetting measures. USCIS stated that it strongly disagrees with the court's decision but will comply while the case remains subject to possible further judicial review.
