USCIS Adjusts EB-5 Fees to Cover Program Costs and Strengthen Integrity Measures

USCIS is updating fees for the EB-5 Immigrant Investor Program so filing fees cover the full cost of running the program. The fees are intended to support application processing, background checks, fraud prevention, audits, and site visits, while helping USCIS meet the processing time goals set by the EB-5 Reform and Integrity Act of 2022. The new fees are scheduled to take effect on November 30, 2026. The final rule follows a fee proposal published by the Department of Homeland Security in October 2025.
