USCIS to Publish New Editions of Form I-539 and Form I-765; Older Editions Will Be Rejected Starting Sept. 15

USCIS will introduce new editions of Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization, effective September 15, 2026. Both forms will carry an edition date of 09/15/26 and were revised to comply with the new final rule establishing fixed periods of admission and extension-of-stay procedures for certain nonimmigrant students, exchange visitors, and foreign information media representatives. The new editions will replace the 08/28/24 edition of Form I-539 and the 08/21/25 edition of Form I-765. Importantly, there will be no grace period for using the older editions. USCIS will accept the current versions only if they are postmarked or electronically submitted before September 15, 2026. Any Form I-539 or I-765 filed on or after that date must use the new 09/15/26 edition, or USCIS will reject it. USCIS has released preview copies of the revised forms and instructions so applicants and practitioners can prepare, but the new editions must not be filed before September 15, 2026.
