USCIS Updates Policy on Biometrics for Detainees

USCIS has updated Policy Manual Volume 1, Part C to discourage frivolous filings and ensure consistent procedures across the agency. The new guidance clarifies that DHS generally will not collect biometrics from detained individuals unless they are in removal proceedings and have an application or petition pending before the Executive Office for Immigration Review. This policy takes effect immediately and applies to all pending and future requests. The update also confirms that USCIS does not approve biometrics requests for individuals detained in DHS or non-DHS facilities who have pending applications with USCIS, removes outdated references to any supposed biometrics-collection agreements with ICE, and reiterates that failure to appear for biometrics appointments will typically result in denial of immigration benefits due to abandonment.
